02  Bonding & Security Types

Bonding & security types

A plain-English overview of bond categories that clients commonly ask about. Whether a particular bond can be sourced depends on independent provider review, the requirements of the beneficiary or obligee, and applicable law.

Contract

Commonly required on construction and other contracts to give the project owner (the obligee) assurance that bid, performance and payment obligations will be met.

Bid
Assures the owner that a bidder will sign the contract and provide any required bonds if the bid is accepted.
Performance
Protects the owner if the contractor does not complete the work according to the contract.
Payment
Supports payment of subcontractors, workers and suppliers on the bonded project.
Completion
Gives a lender or owner assurance that a financed project will be finished.
Maintenance
Covers defects in workmanship or materials for a set period after the work is complete.
Discuss Requirements — Contract

Court & fiduciary

Required by a court or by law where a party must secure an obligation or show that assets will be handled faithfully on behalf of others.

Court
Required in legal proceedings, for example to secure an injunction, attachment or costs.
Appeal / supersedeas
Secures the amount of a judgment while an appeal is pending, typically pausing enforcement.
Trustee
Supports a trustee’s faithful performance of duties to a trust and its beneficiaries.
Executor / fiduciary
Protects an estate or ward by securing the proper conduct of an executor, administrator or guardian.
Discuss Requirements — Court and fiduciary

Commercial & licensing

Often required by government agencies or service providers as a condition of a license, registration, title or account.

Dealer
Required of certain licensed dealers to support compliance with the rules that govern their license.
Vehicle title
Used to obtain a title when ownership documents are missing or incomplete, protecting later claimants.
Tax
Secures the payment of taxes such as sales, fuel or excise obligations owed to a taxing authority.
Utility
Secures payment for utility service, often in place of a cash deposit.
Discuss Requirements — Commercial and licensing

Industry-specific

Sector obligations where regulators or counterparties require financial assurance tied to a particular activity.

Environmental
Supports reclamation, remediation or closure obligations set by environmental regulators.
Oil and gas
Supports obligations such as well plugging, abandonment and site restoration.
Other specialty bonds
Requirements that do not fit a standard category, reviewed individually.
Discuss Requirements — Industry-specific

Descriptions are general and for information only. Listing a bond type does not mean it is available for a particular client or transaction. Availability, terms and eligibility are determined solely by independent providers and the relevant beneficiary or obligee.

03  Additional Financial Resources

Additional financial resources

Beyond surety bonds, some requirements call for a different instrument. Each of the following is a distinct instrument with its own purpose, issuer and requirements.

Private underwriting referrals

Introductions to independent private underwriters for requirements that fall outside standard programs. Whether a privately underwritten bond is acceptable is decided by the relevant beneficiary or obligee.

Discuss Requirements — Private underwriting referrals

Payment guarantees

An undertaking from an independent third party supporting a specific payment obligation to a named beneficiary, issued on that provider’s own terms and criteria.

Discuss Requirements — Payment guarantees

These are distinct instruments and are not interchangeable. Each is subject to independent provider review, availability and applicable requirements, and none is issued or guaranteed by TKO.

04  Process

A measured, confidential process

Our role is to help you reach the right independent provider and keep communications organized. Approval, issuance, pricing and acceptance are never promised and are decided by the provider and the relevant beneficiary or obligee.

  1. Step 1: Confidential discussion

A private conversation to understand your requirement, its timing and the party requesting the bond or instrument.

  2. Step 2: Preliminary needs review

A general review of the information you share to identify which kinds of independent providers may be relevant.

  3. Step 3: Independent provider introduction

Where appropriate, an introduction to one or more independent providers, who carry out their own assessment.

  4. Step 4: Communication coordination

Coordination of communications between you and the provider while the provider’s own process runs its course.

05  Confidential Inquiry
